1. What TinkySpeak Is

TinkySpeak is an Augmentative and Alternative Communication (AAC) application that turns tablets into dedicated speech devices. It provides customizable communication boards, text-to-speech, speech recognition, eye gaze tracking, switch scanning, and related assistive technology features.

2. Subscription Plans

• Free — Core AAC features, any 1 of 65+ languages, custom board creation, letter tracing, eye gaze, switch scanning. Free forever.
• Premium ($3.99/month or $29.99/year) — Everything in Free plus bilateral (two-language) mode, 154+ pre-built boards, 77 tile template packs, venue and weather awareness, stroke recovery mode, QR board sharing, AI board generation, and advanced personalization.

Subscriptions are billed through Apple App Store or Google Play Store. Cancel anytime through your device's subscription settings. Cancellation takes effect at the end of the current billing period. No refunds for partial periods.

3. Your Content

You own everything you create in TinkySpeak — custom boards, tiles, configurations, exported .tinkyboard files. We claim no ownership over your content. You are responsible for any content you create or import.

4. Acceptable Use

You agree not to:

• Use the app for any unlawful purpose
• Reverse engineer, decompile, or disassemble the app
• Interfere with or disrupt the app's functionality
• Distribute the app outside official app store channels
• Use pre-built board templates or tile packs outside of TinkySpeak

5. Intellectual Property

TinkySpeak's design, code, graphics, pre-built boards, and tile packs are owned by AgewellEPM and protected by intellectual property laws. Pre-built templates are licensed for personal use within the app only.

6. Disclaimer of Warranties

TinkySpeak is provided "as is" without warranties of any kind. We do not guarantee the app will be error-free or uninterrupted.

• Speech recognition accuracy varies by device, environment, and speaker
• AI-generated content (boards, stories) may require review and editing
• Offline features depend on previously downloaded models and resources

7. Limitation of Liability

To the maximum extent permitted by law, AgewellEPM shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from use of the app, including communication errors, data loss, or service interruptions.

8. Children & Parental Responsibility

TinkySpeak is designed to be used by children under supervision of parents, guardians, or caregivers. The supervising adult is responsible for:

• Supervising the child's use of the app
• Managing settings and permissions (protected by parent gate)
• Reviewing any AI-generated content
• Managing subscription and purchase decisions

9. Changes

We may update these Terms at any time. Changes will be posted on this page with an updated date. Continued use of TinkySpeak after changes constitutes acceptance.

10. Governing Law

These Terms are governed by the laws of the United States, without regard to conflict of law provisions.
